These terms are an agreement between you and FutureNerds, the company that operates the service. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
If you accept these terms for a school or organization, you confirm that you have the authority to bind that organization, and "you" then means both you and that organization.
To hold an account, you must be at least 18 years old and either an authorized representative of a school or a parent or guardian of an enrolled child.
FutureNerds is not meant for children to use directly. Children's information is entered and managed by school staff and by parents or guardians.
FutureNerds is software for Montessori and early childhood schools. It helps schools manage enrollment, track children, record observations and daily activity, share photos and updates with families, send messages, and handle invoices and subscriptions.
We may add, change, or remove features over time. We try to give notice of major changes, but we are not required to keep any specific feature.
You are responsible for keeping your login details private and for everything that happens under your account. Provide accurate information and keep it up to date.
Do not share your account with others. Tell us right away if you think your account has been used without your permission.
Use the service only for lawful purposes and as these terms allow. Do not misuse the platform, interfere with how it works, or try to break its security.
Do not try to access another school's data or any data you are not allowed to see. Only handle children's data for the school and children you are authorized to support.
Each school owns the data it enters, including children's records, observations, photos, documents, and messages. We do not claim ownership of your content.
You give us the permission we need to host, process, and display your content so we can provide the service. We handle personal data as described in our Privacy Policy and, for children's data, as the school instructs.
Paid plans and invoices are billed through Stripe, our payment processor. By paying, you agree to Stripe's handling of your payment details.
Fees are charged on the billing cycle shown when you sign up or when an invoice is issued, such as monthly or yearly. Unless stated otherwise, fees are due when billed.
If a payment is late or fails, we may retry it, charge applicable fees, and suspend access until the balance is paid. Repeated non payment may lead to termination.
Except where the law requires otherwise or where we state otherwise in writing, payments are non refundable.
We own the FutureNerds software, design, and brand, and all related intellectual property. These terms do not give you any ownership of the software. You may use it only as allowed here.
You keep ownership of the content you create and enter. This section does not change the ownership of customer data described above.
The service relies on third party providers, such as hosting, payment processing, and analytics. Their own terms and privacy practices apply to the parts they provide, and we are not responsible for services we do not control.
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not promise that the service will be uninterrupted, error free, or fit for a particular purpose.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from your use of the service.
Where liability cannot be excluded, our total liability is limited to the amount you paid us for the service in the 12 months before the event that caused the claim.
You agree to defend and hold us harmless from claims, losses, and costs that arise from your misuse of the service, your breach of these terms, or your violation of the law or the rights of others.
You may close your account at any time in your account settings. Some records may be kept as described in our Privacy Policy or as the law requires.
We may suspend or end your access if you break these terms, fail to pay, or create risk for the service or other users. Where reasonable, we will give notice first.
These terms are governed by the laws of [governing-law jurisdiction], without regard to conflict of law rules. Disputes will be handled in the courts of that jurisdiction, unless the law gives you other rights.
We may update these terms from time to time. When we make a material change, we will update the date at the top and, where appropriate, let you know in the app or by email. If you keep using the service after a change, you accept the updated terms.
